Privacy Policy — INFLU:ON

This policy describes how we process the personal data of users of the www.influon.cz website, the INFLU:ON web application and the INFLU:ON mobile app for iOS and Android (together the "Service"), in accordance with Regulation (EU) 2016/679 (GDPR) and Czech Act No. 110/2019 Coll., on the Processing of Personal Data. It complements our Terms and conditions and Terms of use.

1. Who processes your data

1.1. The controller of your personal data is 2bananas s.r.o., Company ID: 21255857, Nové sady 988/2, Staré Brno, 602 00 Brno, Czech Republic (the "Provider" or "we").

2. What data we process

2.1. The mobile app does not collect your location, health data, phone contacts, browsing history or data for ad targeting.

2.2. We do not sell your data and we do not use it to track you across apps and websites owned by other companies.

3. Why we process data and on what legal basis

Providing the Service (managing your account, signing in, displaying your data, invoicing, bookings, notifications, running AI agents) — performance of a contract, Art. 6(1)(b) GDPR.
Customer support and account communication (e.g. password recovery, important notices) — performance of a contract.
Accounting and tax obligations — compliance with a legal obligation, Art. 6(1)(c) GDPR.
Security and prevention of misuse of the Service — legitimate interest, Art. 6(1)(f) GDPR.
Marketing communications about INFLU:ON news — consent, or legitimate interest for existing customers (see Art. 11 of the Terms and conditions). You can unsubscribe at any time via the link in every e-mail.

4. Data you enter into the Service about other people

4.1. If you enter data about your clients, customers or contacts into INFLU:ON (e.g. in the CRM, invoices, bookings or campaigns), you are the controller of that data and we process it as a processor solely on your instructions and for the purpose of providing the Service.

4.2. On request, we will sign a data processing agreement (DPA) with you under Art. 28 GDPR.

5. Who we share data with

5.1. We share data only to the extent necessary to operate the Service, with processors who are contractually bound to ensure the same level of protection as we do:

server and data centre providers in the Czech Republic and the European Union (hosting and data storage),
Comgate, a.s. (payment gateway) for payments,
banks and payment services you connect to the Service yourself (e.g. to load account transactions),
AI model providers, if you use AI agents; only the content needed to complete the given task is shared, and the provider does not use it to train its models,
e-mail and SMS delivery providers, if you use these features,
public authorities, where required by law.

5.2. Any transfer outside the EU/EEA takes place only on the basis of a European Commission adequacy decision or standard contractual clauses.

6. How long we keep data

Account data and user content — for as long as the account exists. After the account is closed, we delete it within 30 days at the latest, and from technical backups within 90 days.
Invoices and accounting documents — for the period required by law (usually 10 years).
Data for marketing communications — until you withdraw consent or unsubscribe.

7. Deleting your account

7.1. You can delete your account and the associated data at any time directly in the mobile app (More → Settings → Delete account) or by sending a request to spoluprace@influon.cz.

7.2. Before deleting, we recommend exporting your data (see Art. 3.9 of the Terms and conditions).

8. Your rights

8.1. You have the right to access your data, to have it rectified or erased, to restrict its processing and to data portability, the right to object to processing and the right to withdraw your consent at any time.

8.2. Send your request to spoluprace@influon.cz. We will handle it without undue delay and within 30 days at the latest.

8.3. You also have the right to lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.

9. Security

9.1. We protect data with encrypted transmission (HTTPS/TLS), access control and encrypted password storage. Data can be accessed only by authorised persons who are bound by confidentiality.

10. Cookies and traffic measurement

10.1. The influon.cz website uses essential cookies and browser local storage, without which the website would not work (e.g. to remember your choice in the cookie bar).

10.2. Only with your consent do we measure traffic using Meta (Meta Pixel). Without consent, the measurement code is not loaded at all. You can withdraw your consent at any time by clearing the website data in your browser settings; the cookie bar will then appear again.

10.3. The mobile app does not use cookies for advertising or measurement.

11. Age limit

11.1. The Service is intended exclusively for persons over 18. Persons under 18 are not allowed to register for or use the Service, including the mobile app, and we do not knowingly collect personal data from them.

11.2. If we find that an account was created by a person under 18, we will close the account and delete the related personal data without undue delay. If you suspect that someone has provided us with such data, write to us at spoluprace@influon.cz.

12. Changes to this policy

12.1. We may update this policy. We will inform you of any material changes by e-mail or in the app. The current version is always available on this page.
